Stephen Baldwin due in court in NY tax case

NEW CITY, N.Y. (AP) ? Stephen Baldwin is set to appear in New York court between appearances on "All-Star Celebrity Apprentice" in hopes of getting past a state tax charge.

The youngest of the four acting Baldwin brothers is due Friday morning in Rockland County Court. He's accused of failing to file state income tax returns in 2008, 2009 and 2010.

Baldwin's lawyer has said he can avoid jail time under a tentative plea agreement. The attorney said Baldwin would have up to five years to pay back $350,000 in taxes and penalties.

When Baldwin was arrested in December, the district attorney said he could face up to four years in prison if convicted.

The 46-year-old Baldwin starred in 1995's "The Usual Suspects." He's a contestant on TV's "Apprentice" with Dennis Rodman and others.

Problems Found with Colorado's Regulation of Medical Marijuana

According to a report recently released by the Colorado State Auditor's office, Colorado's Medical Marijuana Enforcement Division -- which falls under the Department of Revenue -- hasn't been following the law when it comes to regulating the industry in the state, has been underreporting tax revenue and has not been spending its money wisely. Here are the details.

* The Division was established in July 2010 to license and regulate businesses that grow, cultivate and sell medical marijuana products. As of October, the Division was charged with overseeing about 1,440 medical marijuana businesses, with the majority of its funding coming from medical marijuana business application and licensing fees.

* According to the auditor's report, the Division took an average of 23 months to issue final licensing decisions by the Aug. 1 effective date of a two-year moratorium on new medical marijuana businesses. 41 percent of the original license applications received by that date were still pending as of October.

* Some of the approved applications revealed potentially disqualifying information about the applicants, the auditor reported.

* Additionally, the Division spent about $1.1 million in the years 2011-12 to develop a marijuana plant tracking system. However, it fell short about $400,000 due to financial difficulties and still has not implemented the system.

* The auditor also found that the Division doesn't use the prescribed statutory process when confiscating marijuana due to disciplinary actions against a medical marijuana business and "has inadequate controls to ensure that seized marijuana is destroyed properly," the report stated.

* According to the report, the Division suffered 19 consecutive months of net losses, including a loss of $2.3 million in June 2011 because of large capital purchases including furniture, computer equipment and software for the marijuana plant tracking program.

* Some of the furniture purchases included $28,000 for seven desk extenders, $16,000 for three cubicles and $4,200 for four office chairs.

* "We reviewed these purchases and found that the Division did not take sufficient steps to ensure that these expenses were reasonable and appropriate," the report stated. "Specifically, the Division did not use a competitive bidding process to outfit its four offices and instead purchased the bulk of its furniture from Colorado Correctional Industries."

* The auditor's report also revealed that about $760,000 of sales tax revenue generated by 56 dispensaries in 2011-12 was not reported by the state's Department of Revenue.

* Due to financial difficulties, the Division laid off most of its staff in 2012, the report stated, adding that weaknesses in fee-setting, strategic planning and expense controls contributed to those financial problems.

* According to the Denver Post , when presented with the audit on Thursday, the legislative committee in charge of drafting a bill on recreational marijuana regulations began questioning whether the Division could handle the added responsibilities of recreational marijuana.

* "If they couldn't handle the little piece they have now," said Rep. Brian DelGrosso, R-Loveland, "there's no way we can trust them to handle more.

Intestinal bacteria may be responsible for at least part of the fat-shedding effects of a popular weight-loss surgery, a new study in mice suggests. Those naturally occurring bacteria not only trim the tummies of mice that have had the surgery but, when transplanted into mice that have not had surgery, cause them to lose weight as well.

Roux-en-Y, the most common technique for gastric bypass, diverts food around most of the stomach and upper small intestine. Some patients go on to lose large amounts of weight, and the surgery may produce other health benefits, such as improving symptoms of type 2 diabetes (SN: 9/10/11, p. 26). In mice, those benefits stem from a bacterial blend fostered by bypass surgery, researchers report March 27 in Science Translational Medicine.

The finding could be a first step toward ?bypassing the bypass? as a means of treating obesity and diabetes, says coauthor Lee Kaplan, a gastroenterologist who heads Massachusetts General Hospital?s Weight Center. Possible treatments may include replacing or augmenting an obese person?s intestinal community.

Still, says Guilherme Campos, a surgeon at the University of Wisconsin School of Medicine and Public Health in Madison, the study was done in mice, so the role that gut microbes play in humans? weight loss is unknown. ?Is it the main driver? Likely not, but it is still likely one of the components that assist gastric bypass patients to lose weight in the long run.?

Previous studies of people and rats have found that the natural mix of microbes in the intestines changes after gastric bypass, with some groups growing more prominent and others diminishing in number. No one knew whether the altered microbial composition was merely a side effect of the surgery, or whether shifting bacterial populations could help people lose weight.

To find out, Kaplan and colleagues fattened up mice then performed either bypass or a sham surgery on the animals. Mice in the bypass group lost about 29 percent of their body weight within three weeks of the procedure. But even before the mice dropped weight, those in the bypass group already had an altered mix of intestinal bacteria.

Compared with the sham operation group, the bypass mice had more of certain types of microbes called Gammaproteobacteria, particularly Escherichia species. Some species of Escherichia are pathogens, but others help prevent inflammation and maintain intestinal health. Bypass mice also had more Akkermansia bacteria, which can feed on mucus lining the intestines, particularly when the host is cutting calories. The researchers speculate that the microbes somehow trigger fat-burning changes in the host?s metabolism.

Then the researchers transplanted bacteria from the intestines of bypass mice into mice that had been raised without any bacteria. The formerly germ-free mice slimmed down, trimming about 5 percent of their body weight, even though they started out lean. Germ-free mice that received bacteria from the guts of sham surgery mice actually packed on a bit of fat.

The researchers are investigating what the bacteria do to cause fat reduction.

Bacterial transplants might eventually help some people, but they won?t solve the global obesity epidemic, Campos says. A person?s social environment and exercise habits are far more complex than a mouse?s. ?The factors that lead to morbid obesity in humans are completely different than what is seen in a laboratory setting,? he says. Patients who don?t change their lifestyles along with their gut microbes may regain lost weight, he says.

Anti-rape video in response to Steubenville trial coverage goes viral

A University of Oregon film student felt compelled to respond to some of the issues surrounding the Steubenville rape case -- and has 1.3 million views on YouTube.

Samantha Stendal, 19, directed ?A Needed Response? and addressed it to ?the Steubenville rapists ? or any rapists out there,? in order to show the world how real men treat women.


"It is horrifying to me that some people can say that people deserve rape when they are passed out," said Stendal to the NY Daily News.

In Stendal?s 26-second-long video, a woman (Kelsey Jones) pretends to be passed out, and a man (Justin Gotchall) gets her some water and places a pillow under her head. Then he faces the camera and says, ?Real men treat women with respect.?

"I was studying for my finals, and on the side I was reading about the Steubenville rape case. I grew very frustrated with the media," Stendal told NBC News on Tuesday. "That's when I came up with the idea for this video."

Gotchall, who is a philosophy major, added, "After we saw the media coverage of the Steubenville rape cases, we just had to do this."

"I think this video is powerful in its simplicity," Desertra87 posted as a comment on YouTube. After being up only four days, the video had more than 4,000 comments and more than a million views.

Last week, Steubenville High School football players Trent Mays and Ma?lik Richmond were convicted of raping a 16-year-old girl at a raucous house party in the small Ohio town.

The story had already made headlines because of the issues surrounding the case, such as social media harassment and teenage partying gone wild. But media coverage following the convictions generated even more controversy and angered many when some reporters seemed to focus on the loss of the two football players? bright future -- and not on the victim?s trauma.

"What really upsets me is what the news is going to, what the Internet is going to ? which is asking what the victim could have done differently," Stendal told KVAL 13 News in Eugene, Ore. "I'm upset that in our culture that is one of the first questions asked."

Stendal, a sophomore, added, "The message I hope that people can get from this video is that we need to treat one another with respect.?No matter what gender, we should be listening to each other and making sure there is consent."

Stendal, now on her spring break, is applying for video internships.

T-Mobile kills off contracts, simplifies plans

T-Mobile is significantly changing the way it sells mobile phone services, eschewing long-term contracts entirely and offering only month-to-month plans. It could be a better deal for some, but it's not quite the "reinvention" the company calls it.

At its "Un-Carrier" event Tuesday, T-Mobile CEO John Legere disparaged the state of the mobile industry as, among other things, "smartphone hell," and pointed out that waiting out a two-year contract in order to qualify for a subsidized, new phone was unthinkable for gadget lovers.

And the contracts themselves, he said, are confusing and misleading ? and he didn't mince words. "This is the biggest crock of s*** I've ever heard in my life," he told the crowd. "Do you have any idea how much you're paying?"

With that, he shared T-Mobile's new pricing structure, which is less a new idea than a new focus. All plans are monthly, with no obligation at all, following the lead of such growing pre-paid services as TracFone and Virgin Mobile.

At a starting rate of $50 for unlimited calls, text and data (with tiered limits on high-speed service), the plans undercut Verizon and AT&T significantly.

The catch is that the cost of your phone won't be subsidized or covered entirely by the carrier, as larger companies tend to do with new, high-end phones like the iPhone and Galaxy S4. T-Mobile asks customers to choose between two options: Pay the cost of the phone upfront, or put some money down toward it, and then pay $15-20 a month until you've paid the whole thing off.

As Legere points out, the other companies do this too by simply increasing the amount you pay monthly ? but they don't let you choose the terms, and your bill doesn't go back down once you've paid the full cost of the device.

Does this mark the beginning of a global change in carrier strategies? Probably not, said analyst Jeff Kagan in a note:

I would say there would be absolutely no way the larger and stronger competitors will make such a dramatic shift. There is no reason. Now if T-Mobile pulls a rabbit out of the hat and starts to win incredibly strong business and takes significant share away from one or more leaders, then all bets are obviously off, but I really don?t think that will happen.

It's a gamble, but pre-paid services are on the rise: Consumers are becoming fed up with expensive contracts, and high-end phones are available on smaller carriers now instead of just the major ones.

As for whether the new T-Mobile plans are a better choice than the competition for you or your family, that's a more complicated question, depending on how much data is consumed, how many devices per person, how many people, and so on. One person buying an iPhone 5 on T-Mobile and opting for 2GB of data will pay less over two years, but The Verge's calculations show that when unlimited data and family plans enter the equation, the contest is much closer.

The new simplified plans can be checked out at T-Mobile's website, and questions might be answered by the company's FAQ.

Seasoned skiers want to know there?ll be snow to greet them once they reach the slopes, but for the beginner too, greater heights often mean the presence of powder on the lower slopes, and can ensure hassle-free skiing to and from your lodgings. At this stage in the season, it?s smart to head for the ski villages, which still promise a few months of cold weather. But where in the world can these record-breaking resorts be found?

France boasts most of the soaring climes in Europe and with its champion Val Thorens being the highest of them all, snow-sure is a by-word that gets used a lot in the French Alps. A good range of easy and challenging runs bordering the vast Three Valleys area keep this purpose-built resort thronging. Across the Atlantic, the soaring heights of Whistler Blackcomb in British Columbia is home to one of the most extreme vertical drops in North America and the ski area itself is a hotbed of statistics, with a total of 38 lifts spanning one of the largest and most highly-rated resorts in the world. There?s a worthy rival over the border into the US, however, with Breckenridge in Colorado recently installing an impressive chair-lift that reaches heights of almost 4,000 meters.

The ski resort of Chacaltaya in Boliva held the title of the tallest in the world until just a few years ago, when melting snows forced it to close down. Thankfully, oxygen masks are provided. Elsewhere on the continent, Iran presents a surprising alternative to many lower European resorts with the high altitudes and reliable snows at places like Dizin, near Tehran.

Of course, the other advantages of opting for high-altitude skiing are that you can be a bit more flexible in your timing and land some bargain holidays if you plan well. Try grabbing accommodation at the lower villages near the mountain-top runs; less convenient but more value for your money. Post-Easter ski trips can be a more peaceful experience in any case and with a few snow-sure days or weeks to look forward to, you can practice those turns at your leisure.

NICOSIA, Cyprus (AP) ? Banks in Cyprus are to open for the first time in more than a week on Thursday, operating for six hours from noon (10:00 GMT), but restrictions will be in place on financial transactions to prevent people from draining their accounts.

Among the capital controls, cash withdrawals will be limited to 300 euros ($383) per person each day. No checks will be cashed, although people will be able to deposit them in their accounts, according to a ministerial decree that was released late Thursday.

The controls will be in place for four days.

Cyprus's banks were closed on March 16 as politicians scrambled to come up with a plan to raise 5.8 billion euros ($7.5 billion) so the country would qualify for 10 billion euros ($12.9 billion) in much-need bailout loans for its collapsed banking sector. The deal was finally reached in Brussels early Monday, and imposes severe losses on deposits of over 100,000 euros in the country's two largest banks, Laiki and Bank of Cyprus.

Since Monday's deal, Cypriot authorities have been rushing to introduce measures to prevent a rush of euros out of the country's banks when they do reopen.

Other capital controls include a cap of 5,000 euros on transactions with other countries, provided the customer presents supporting documents. Payments above that amount will need special approval.

Travelers leaving the country won't be able to take with them anything over 1,000 euros in cash ? as well as the equivalent sum in foreign currency.

Tuition fees and living expenses of up to 5,000 euros for three months will be permitted for overseas students, but documentation must be provided proving the student's relationship to the dispatcher.

Also investors will also not be able to terminate fixed-term deposit accounts before they mature unless the funds are to be used for the repayment of a loan in the same bank, the decree says.

In the capital, Nicosia, armed police officers guarded several trucks carrying containers arriving at the country's Central Bank, while a helicopter hovered overhead.

The contents of the trucks could not be independently confirmed, although state-run television said they were carrying cash flown in from Frankfurt for the bank reopening.

Meanwhile, private security firm G4S will dispatch 180 of its staff to all bank branches across the island to keep a lid on any possible trouble, said John Argyrou, managing director of the firm's Cypriot arm.

"Our presence there will be for the comfort of both bank staff and clients, but police will also be present," he said.

Argyrou said he doesn't foresee any serious trouble unfolding once banks open their doors because people had time to "digest" what has transpired.

"There may be some isolated incidents, but it's in our culture to be civil and patient, so I don't expect anything serious."

Another 120 staff from G4S would be assigned money transportation duties.

In Nicosia Wednesday night, several hundred demonstrators marched from the European Union's offices in the capital to Parliament to protest the bailout plan.

Before its collapse, Cyprus's banking sector grew to nearly eight times the size of the country's economy, mainly on the back of substantial deposits from Russia. This sparked accusations that the country was being used by Russian criminals to launder their money. Over the past week, the government in Moscow has criticized Europe's handling of the crisis in Cyprus.

Russian millionaire businessman Andrey Dashin told the Associated Press in an interview that he doesn't believe his fellow countrymen would rush to pull businesses or money out of the country once banks reopen, despite the fact that many will take a hit from a tax on accounts over 100,000 euros in both Bank of Cyprus and Laiki.

"There won't be a substantial Russian run" on Cypriot banks, said Dashin, 37, who runs his currency speculation company ForexTime from a brand-new high-rise in the southern coastal resort of Limassol. Dashin doesn't stand to lose on his deposits which aren't in either of the top two Cypriot banks.

"Russians are much more accustomed to such circumstances, we've had so many crisis in Russia...I don't have the feeling that (Russians) are ready to pull out their business or money out of their country," Dashin said.

But he said Russians want to have a "clear picture" on the kind of capital movement limits that will be imposed so as not to choke off businesses, warning that tight restrictions would be "a sign for businesspeople that their cash is trapped."

Dashin dismissed reports that Cypriot banks were being used to launder dirty Russian cash as unproven rumors and urged Cyprus to bring in internationally respected auditors to clear the air.

Under the deal clinched in Brussels early Monday, Cyprus agreed to slash its oversized banking sector and inflict hefty losses on large Laiki and Bank of Cyprus depositors.

Laiki is to be restructured, with its healthy assets going into a "good bank" and its nonperforming loans and toxic assets going into a "bad bank," officials have said. The healthy side will be absorbed into the Bank of Cyprus.

The board of directors of both banks has been fired and administrators appointed to handle the restructuring and absorption, the banking official said.

Bank of Cyprus CEO Yiannis Kypris issued a statement saying the Central Bank governor had asked him verbally Wednesday to resign.

"These are very difficult times for everyone. The Bank of Cyprus was and must remain the basic support of the economy and our society in the effort to deal with the crisis our country is going through," Kypris said. "I hope that the handling of this transition phase will respect the workers, shareholders and customers of the Bank of Cyprus."

Cypriot officials said the deal would mean the country would shift its focus away from being an international center of financial services. That is expected to cost jobs, adding to the unemployment rate which now stands at around 14 percent.

The country's foreign minister said his country almost left the eurozone during last week's bailout talks.

Ioannis Kasoulidis told German daily Frankfurter Allgemeine Zeitung in an interview to be published Thursday that dropping the common currency was "a possibility which we seriously considered for a while."

Windows 8 productivity apps get much-needed facelift

Microsoft has announced updates to its Mail, Calendar, and People apps in Windows 8, making them somewhat more viable tools for power users. The updates go live on Tuesday.

Mail received the most improvements: Users can now select to view only unread messages, flag emails as important, or manage them in folders ? all critical features for email clients that seemed a rather glaring omission from the original application.

Likewise, the ability to search through mail archived on the mail server, also added this week, is a core feature that heavy emailers resort to constantly.

Composing messages has also been improved slightly, making the addition of links and bulleted lists easier.

The Calendar app has had its color scheme replaced with a less intense one; Calendar items will now only have a bar of color on the side indicating their type, rather than being entirely that color. It will now also provide others' schedules when inviting them to a meeting, streamlining that process.

Lastly, the People app should be a bit easier to navigate now, using app commands available by swiping down from the top of the screen. Users can also now filter the "What's new" tab by social network, and post directly to Facebook.

The updates will be live Tuesday, at which point they will appear in the updates section of the Windows Store.

Amid Threats, Iran Hints at Direct Talks

According to a new report from the Associated Press, Iran's Supreme Leader Ayatollah Ali Khamenei is claiming his country would be willing to hold direct talks with Washington over its nuclear program.

Another report from Reuters revived more blustery talk, though, as Khamenei also warned that Iran would destroy Tel Aviv and Haifa if Israel preemptively attacked Iranian nuclear facilities.

The following is further information on the Iranian nuclear program headlines.

Khamenei issues threat to Israel

Khamenei noted he was not optimistic that talks would stop sanctions currently imposed on Iran and strongly supported by the United States at the U.N. Sanctions include a total oil embargo and banking restrictions that make it difficult for non-observers of the embargo to make payments for deliveries. Iran's oil and gas exports are down 50 percent from sanctions, according to the AP.

Reuters reported that in Khamenei's statements he threatened to "raze Tel Aviv and Haifa to the ground" if Israel launched a military invasion.

Diplomatic talks progressing

President Barack Obama was in Israel on Thursday, where he said that "America will do what we must to prevent a nuclear Iran," according to Reuters, but also noted that he and other world leaders agreed diplomacy was still possible before Iran could feasibly achieve its nuclear ambitions.

Russia sounded an optimistic note according to another Reuters report. Deputy Foreign Minister Sergei Ryabkov, Russia's chief negotiator on the subject of a nuclear Iran, said that "this progress is real but it is not sufficient to speak of a definitive shift" regarding talks in Istanbul, but also noted that the progress isn't "irreversible."

The next meeting between the six powers of Russia, the U.S., Britain, France, Germany and China with Iran will be April 5 and 6 in Almaty, Kazakhstan. The Istanbul meeting between the powers was to iron out details of proposals made in the previous round of talks.

U.S., allies concerned about Iranian plutonium-producing reactor

Another report from the AP indicated that while the U.S. and its allies discussing uranium-enrichment production which is a more immediate concern, another part of the nuclear program focuses on the creation of a plutonium-producing reactor that could be functional in the next year.

While Iran claims it won't build a reprocessing plant that would enable plutonium to be used for bombs, Israel doesn't believe that, according to the article. Israel bombed the Osirak reactor in 1982 and a site in Syria that the International Atomic Energy Agency identified as being "very likely" an almost completely built reactor.

Soldier?s cat makes perilous journey from Afghanistan to Oregon

A decorated veteran took quite a risk in getting his new friend from the sandbox to the litter box.

And along the way, Staff Sgt. Jesse Knott found an unlikely ally in his elaborate plan to evacuate his adopted cat from the war zone in Afghanistan.

In an interview with KPTV, Knott explains that he met his pet cat, Koshka, at his base of operations inside the war-torn country. Koshka was a stray cat, serving a practical purpose as the unofficial mouse catcher. At first glance, Koshka was the "purrfect" weapon.

However, not having a real owner, the cat was often subjected to neglect and cruelty.

"He was showing some signs that people weren't taking very good care of him," Knott said. ?I found paint in his fur a couple of times. And then, people took clippers and shaved his back.?

And as Koshka adapted to life inside Knott?s small workspace, the two formed a tight bond. In fact, it was in the aftermath of a bloody battle that Koshka provided Knott with some much-needed solace.

"I'd lost hope in myself. I'd lost faith. Then all of a sudden this cat came over, and it was like ?hey, you are you,'" he said.

But that same act of kindness made it clear to Knott that if he wanted to do what was best for Koshka, then he had to get his beloved cat out of Afghanistan and to his family home in Oregon.

"He pulled me out of one of my darkest times, so I had to pull him out of one of his darkest places," he told the station.

That?s when Knott staged an elaborate and risky evacuation plan for his cat. First, he enlisted the help of a local Afghan interpreter who transported the cat to Kabul.

Both the cat and the interpreter were at risk. Knott had to trust that the man would take care of the cat, but he also knew that if the man were discovered to be helping an American, his own life would be at risk.

"The risk to him was immense," Knott said. ?This is a cat with a purple collar and an American-brand cat carrier, going halfway across Afghanistan. Going across God knows how many Taliban checkpoints.?

But the interpreter did eventually get Koshka to the airport in Kabul. From there, Knott?s family spent $3,000 to fly Koshka to Oregon, detouring through Islamabad, Pakistan, and New York City.

Knott himself has since left Afghanistan and is now stationed in Washington state. His service in the military will soon be over, and he says he can?t wait to be permanently reunited with the animal that meant so much to him during a time of physical and emotional vulnerability.

"He was my saving grace," Knott told KPTV. "He kept me alive during that tour."

Zynga relaunches gaming site, loosens Facebook ties

SAN FRANCISCO (Reuters) - Online game publisher Zynga Inc relaunched its website on Thursday, allowing users to play its games without first signing on to Facebook, a significant step toward establishing its independence from Facebook Inc.

The relaunch of Zynga.com is the latest step in the slow dissolution of a special partnership that once bound two of the most influential players in the social Internet industry.

Tim Catlin, general manager of Zynga.com, told Reuters he believed Zynga's players wanted to create unique player names that were not tied to their Facebook accounts, which displays their real names.

"You had to use your Facebook account to play previously, but this is going to change going forward," said Catlin, who added that existing players will still be able to log in with their Facebook accounts.

New players, however, will be able to easily sign up without using Facebook credentials - long a hallmark of many Zynga games.

"We've been able to greatly streamline that process," Catlin said of the new Zynga.com website, which has been in the works for the past year.

Founded in 2007, Zynga achieved a searing growth rate in its early years by exclusively tapping Facebook's network to gain new users while offering games directly within Facebook.com web pages.

For several years the companies enjoyed a lucrative and symbiotic relationship, with Zynga deriving close to 90 percent of its revenues from Facebook games, while Facebook received roughly 15 percent of its income in the form of fees from Zynga.

But Zynga's competitive advantage on the world's largest social network gradually shrank as other publishers entered the market, and the company's leadership has been faulted for not diversifying away from Facebook's platform earlier.

Last year, Facebook and Zynga announced that they agreed to amend a longstanding deal that had given Zynga special privileges on the Facebook platform.

Rather than relying on Facebook's communications features, Zynga has focused on building out features of its own such as its "social stream," a bar that is displayed within games to connect players to each other.

Zynga shares were up less than 1 percent at $3.38 after hours.

Wisconsin authorities announced Tuesday they will shut down one of nation's most popular nude beaches on weekdays after struggling for years to curtail sex and drugs on the sandbar and surrounding woods.

Nudists from around the country have been traveling to the public beach on the Wisconsin River near Mazomanie, about 25 miles northwest of Madison, for decades as word spread that prosecutors in ultra-liberal Dane County wouldn't go after anyone for showing skin. But visitors haven't stopped at just stripping down. They've been slipping off into the woods for trysts and drugs.

Authorities say that's crossing the line, but they haven't been able to stop the shenanigans. Their frustration reached a tipping point Tuesday, when the state Department of Natural Resources announced it will close the beach, the islands immediately off it and the surrounding woods to the public on weekdays, when wardens say troublemakers tend to operate unseen. The closures begin immediately. The area will remain open on weekends, though.

Bob Morton, executive director of the Austin, Tex.-based Naturist Action Committee, which lobbies on behalf of nudists, has visited the beach several times. He criticized the DNR for not consulting with beachgoers before closing the area.

"Honestly, we're on their side when it comes to enforcing things that are lewd and lascivious," Morton said. "There's something to be said about consulting the users of the place. There's got to be more to this somewhere."

Nate Kroeplin, who supervises DNR law enforcement in Dane County, said wardens reviewed data on citations and determined most violations happen on weekdays, when fewer people are around to police each other's behavior. Of the 92 citations wardens issued for disorderly conduct or drugs in the beach area between 2008 and 2012, 83 were given on weekdays, he said.

"Obviously we're disappointed when we have to shut any portion of our property down," he said. "But our ultimate goal is to have a safe place anybody can feel comfortable using. And with the current activity going on down there, that's just not the case."

The beach has been a problem for wardens for years. The DNR purchased the area in 1949 in an effort to open up more land for public hunting, fishing and recreation. Droves of nudists claimed the beach as their own, though, emboldened by local prosecutors' indifference. Wisconsin law makes exposing one's genitals a misdemeanor, but a long line of Dane County district attorneys have said naked people must cause some kind of disturbance before they can be prosecuted. The DNR estimates as many as 70,000 people, some from as far away as Florida, have visited the beach some summers.

With all the skin has come sex and drugs. The agency closed the area at night and banned beach camping in the late 1990s. Authorities also installed a gate blocking vehicles in hopes of stopping people from driving down to the beach in search of quick sex.

In 2007, wardens closed off parts of the woods around the beach to discourage sex in the underbrush and cut down brush around the beach to eliminate cover. But arrests for sex and drugs around the beach still hit a five-year high in 2011; wardens arrested 26 people for sex and 16 people for drugs in just nine days of surveillance.

The DNR closed another 70 acres around the beach last spring, but Kroeplin said it hasn't stopped people from cruising the beach parking lot on weekdays, when relatively few people are around to complain. Last summer, wardens issued 19 citations for sex and three for drugs over five or six days of surveillance, Kroeplin said; 16 citations were issued on weekdays compared with six on weekends.

"It's pretty incredible to see the amount of traffic that pulls onto the property," Kroeplin said. "Everything we've done has not made any difference."

OKLAHOMA CITY ? A family dispute erupted into violence this week at Mercy hospital.

Oklahoma City police arrested a woman after she attacked another woman inside a dying man?s hospital room.

The stabbing took place after a mother brought her daughter to see the girl?s adopted father, who is said be on his death bed.

The dying man?s wife got angry and allegedly attacked the mother with a knife.

The violence comes after criminal charges of sexual abuse within the family.

The victim said the dying man, 53-year-old Michael Pittser, and his wife, Teresa, have had warrants out for their arrest for nearly nine months.

?These people adopted my kids and turned around and abused them,? Lena Jones said.

Last year prosecutors in Lincoln County charged Michael Pittser with lewd molestation and his wife Teresa with child neglect.?Mercy stabbing

Jones said her 14-year-old daughter wanted to make peace with her adopted father before he died.

?She wanted to tell him she forgave him,? Jones said. ?She wanted closure with it.?

?One of the relatives got upset and didn?t feel like they belonged there or had to the right to be there,? OKC Police Master Sgt. Gary Knight said. ?Ultimately, the confrontation led to the victim being stabbed.?

Police arrested Teresa Pittser for allegedly assaulting Jones with a buck knife in the hospital room.

Jones said she hopes Michael Pittser survives his illness and goes to jail along with his wife.

?I think he should suffer for the rest of his life instead of dying,? Jones said. ?With her, I hope the system does right and she does time.?

The victim was stabbed in the hand and stomach.

The wounds were not very deep.

She said she will be fine.

Santa Fe Goes Rogue on Gay Marriage

Same-sex marriage is already legal in New Mexico, if Santa Fe city officials are to be believed.

Citing an ABC News-Washington Post poll this week that showed growing support for gay marriage nationally, Santa Fe Mayor David Coss, City Attorney Geno Zamora and Councilor Patti Bushee announced their support for gay marriage Tuesday and recommended that city clerks begin doling out marriage licenses to couples, regardless of gender.

"Marriage law in New Mexico is gender-neutral and does not define marriage as between a man and a woman," Zamora said in a statement from Santa Fe city government. "New Mexico already recognizes valid marriages performed in other states between same-sex couples; it would violate our state's constitution to deny equal rights in our own families."

Coss is a Democrat, but his coming out in favor of gay marriage echoes the sentiments of Sen. Rob Portman, R-Ohio, because he, too, has a gay child. Portman announced his support for marriage equality last week, saying he wanted his gay son to enjoy the same opportunities as his other children.

Some marriage-equality activists see the Santa Fe mayor's declaration as a positive step forward and others worry it could end in heartbreak for the couples that heed the mayor's call to marry.

Gregory T. Angelo, executive director of pro-gay rights Republican organization Log Cabin Republicans, compared Santa Fe to San Francisco in 2004 when then-Mayor Gavin Newsom ordered county clerks to give marriage licenses to gay couples, resulting in more than 3,000 marriages that were invalidated by California Supreme Court six months later.

"I think this could be a mess," Angelo said today. "It's also unfair, I think, to gay and lesbian couples who might obtain marriage licenses through this initiative, because they would not have the guarantee of protections that would be afforded to them if this was handled on the state level."

But law professor Andrew Koppelman of Northwestern University believes this is a straightforward case. For county clerks to refuse marriage licenses to same-sex couples would be illegal discrimination, in his view.

"For a long time, this argument was a loser because people presupposed without any legal authority to support it that same-sex marriage was impossible. But that has changed," Koppelman said today. "This argument that same-sex couples already have a right to marry under existing law as a legal argument could very well be a winner in court."

Stuart Gaffney of Marriage Equality USA is cautiously optimistic about Mayor Coss' call to county clerks.

Gaffney recognized the connection between the San Francisco case, but said those invalidated marriages all paved the way for the Supreme Court case on same-sex marriage being heard next week.

"Whether people are able to finally say, 'I do,' in Santa Fe or across New Mexico at this moment, I can't say for sure. But it's part of the process that is bringing marriage equality closer every day," Gaffney said.

But Gaffney, who married his husband in California before the 2008 passage of Proposition 8, warned that couples who take the mayor up on his offer are opening themselves up to more than just the bliss of married life.

"It can be heartbreaking for couples to see their marriages come and go, so I certainly would not advise anyone to enter into a marriage that may become a test case, unless they're ready to make that part of their marriage vows," Gaffney said. "I would ask them to consider it very carefully."

Gaffney told ABC News in February that activists "have never been more hopeful" about the future of same-sex marriage in America. He reiterated that optimism today.

"There's no question that we're going to see it in our lifetimes, it's just how much longer do we have to wait," he said.

Ultimately, same-sex marriages in New Mexico could face opposition from New Mexico Republican Gov. Susana Martinez.

Martinez has gone on record against legalizing same-sex marriage, as recently as late February.

There probably isn?t one person in America whose life has not been touched by cancer, whether the individual has been diagnosed with some form of it or someone they love has been. Given this probability, employers across the country must be prepared for the day when cancer hits their workplace.

Thus, the U.S. Equal Employment Opportunity Com????mis??sion (EEOC) released a Q&A on cancer in the workplace and the Americans with Disabilities Act (ADA). But the ADA is not the only law you must consider. The Family and Medical Leave Act (FMLA) may also be a factor. It is up to you to determine which law applies and how to comply when they both do.

Here are some fast ADA and FMLA facts you should know, which apply to medical conditions beyond cancer.

ADA: The amount of time an employee may take is open-ended, depending on what will create an undue hardship for the employer.

FMLA: This law requires a maximum of 12 weeks of leave within a 12-month period.

ADA: Leave may be taken only for the individual?s disability.

FMLA: Leave may be taken for an employee?s own serious health condition or that of his/her spouse, parent or child.

ADA: There is no minimum length of employment or number of hours worked that an employee must meet before requesting leave as an accommodation.

FMLA: The employee must have worked for at least 12 months and 1,250 hours in order to receive leave.

ADA: Leave may be taken only for fairly serious health conditions.

FMLA: More minor conditions, such as the flu, may be covered.

ADA: Instead of granting leave as an accommodation, you may assign an employee to a light-duty position.

FMLA: You may not require an em??ployee to take a light-duty job in lieu of FMLA leave.

Rule of thumb: When provisions of the ADA and the FMLA collide, you need to look at which law provides the employee with greater rights.

VATICAN CITY (AP) ? The two American cardinals sat on the stage, microphones in hand, fielding questions from the world's news media on everything from the delayed arrival of some of their colleagues to their own wardrobe choices if elected pope.

Most experts doubt the upcoming conclave will select an American pope, but the U.S. cardinals are already exerting a surprising amount of control over the message ? simply by talking. Their lively daily briefings contrast sharply with the sober summaries from the Vatican spokesman and almost nothing from anyone else.

More than 100 journalists and two dozen television crews from the U.S., Britain, France, Spain, Brazil, Mexico, Germany and Italy showed up Tuesday, packing an auditorium for what has become the daily "American Show" at the North American College, the U.S. seminary just up the hill from the Vatican.

Cardinals Daniel DiNardo of Galveston-Houston and Sean O'Malley of Boston held court, gamely trying to answer questions about when the conclave will begin, why five voting-age cardinals still hadn't shown up and whether they'd all be home in time for Holy Week ? all without violating their oath of secrecy about the closed-door deliberations.

"I don't think I can get into anything in particular about what happened in any of the congregations today," DiNardo began.

He then delivered a message that several American cardinals have repeated in recent days, responding to questions about whether the problems in the administration of the Holy See were weighing on the deliberations about who might next be pope.

"Obviously we want to know and learn as much as we can relative to governance in the church," DiNardo said. "The Curia (Vatican bureaucracy) is part of that issue. Certainly we want to discuss and learn what we can, and I think that will go on as long as cardinals feel we need the information."

It's a message that has made headlines, simply because it's one of the few coming out.

"Yes, the American cardinals, by being willing to speak, have filled the media void," said the Rev. Thomas Reese, author of "Inside the Vatican," a how-to guide about the Vatican bureaucracy.

But, he noted, the message is also old. "People have been calling for the reform of the Curia since Vatican II."

DiNardo and O'Malley drew laughs when one reporter asked O'Malley, a member of the Capuchin order, if he would continue to wear his trademark brown robes if elected pope.

"I've worn this uniform for over 40 years and I presume I will wear it until I die," he said. "I don't expect to be elected pope, so I don't expect to have to change."

At the Vatican, meanwhile, spokesman the Rev. Federico Lombardi presided over a more sedate affair, showing a videotape of the three silver and brass flying-saucer-shaped urns into which the cardinals will cast ballots during the conclave, and updating reporters on the whereabouts of the five MIA cardinals.

"Everyone knows how to evaluate his commitments," Lombardi said when asked what the cardinals could possibly have on their agendas that was more important than being in Rome for the election of a pope. "They know they have the obligation and commitment to come for the conclave, and they know the congregations have begun and are making their plans to arrive."

Those still making their way to Rome were Egyptian Patriarch Antonios Naguib, and Cardinals Karl Lehmann of Germany, Jean-Baptiste Pham Minh Man of Vietnam, Kazimierz Nycz of Poland and John Tong Hon of Hong Kong.

Naguib and Lehmann reportedly arrived later Tuesday, while Nycz had to preside over a conference of bishops at home and told reporters in Warsaw he'd be in Rome by Wednesday. The Asian cardinals, Tong and Man were either en route or scheduled to leave later Wednesday, their offices said. Asked why they were late arriving for such an important meeting, the offices said the men were busy handling domestic matters.

Lombardi also announced that the Sistine Chapel had closed to visitors ? one of the first signs that the election was nearing. Workers in the coming days will install a raised false floor to cover anti-bugging devices, as well as hook up the stove where the ballots will be burned.

When asked if he had considered inviting cardinals to his briefings, Lombardi said he thought about it and decided against it.

"The conclave and the path towards it ... is an election that each member makes in his conscience before God," he said in an email. "That requires a reflection by the college as a group that can develop and mature in total freedom."

He said the oath of secrecy also was a problem, limiting how much cardinals can divulge. And then there's the matter of which cardinals to invite given the global makeup of the College of Cardinals.

"If some cardinals think it's useful to communicate, naturally preserving the reserve they've committed themselves to concerning the election, I have no objections," he said. "I do my part helping journalists."

DiNardo acknowledged it was "more American" to brief the media when it was pointed out to him that the U.S. cardinals were the only ones hosting regular readouts of what the cardinals had been up to.

"We want to honor the confidentiality of the discussions, but at the same time let people ? and letting our own folks know at home ? that we are meeting day by day, there are interesting things happening and we are moving ahead," he said.

That sense of accountability ? gleaned after the sex abuse scandal humbled the U.S. church and taught its leaders to be more transparent ? is not widespread among church leaders elsewhere. Only a handful of cardinals from other countries have stopped to chat with journalists waiting outside the meetings; a few have granted one-on-one interviews with media, mostly from their home country. None are hosting daily briefings.

"I love the strategy of the U.S. cardinals," said Iacopo Scaramuzzi, Vatican correspondent for the Italian news agency TMnews. "The others don't do it for a variety of reasons: Some because they haven't developed a culture of church transparency, others because they don't have the means, others don't have time. But I think the European bishops could follow their example."

The U.S. media team is substantive: Sister Mary Ann Walsh, spokeswoman for the U.S. Conference of Catholic Bishops, is running the show, and most of the seven U.S.-based American cardinals have come with a spokesperson. Walsh said she has received "hundreds" of requests for one-on-one interviews with the media-friendly Americans.

American cardinals are tweeting and blogging and Cardinal Timothy Dolan of New York, considered a papal contender, is still conducting his weekly radio show, which will broadcast live on SiriusXM's "The Catholic Channel," on Wednesday from the North American College.

"As the Vatican is the kingdom of silence, especially during those very specific times, this is a real breath of fresh air," said Fr?d?ric Mounier, the Vatican correspondent for the French Catholic newspaper "La Croix," who was on hand for Tuesday's session.

But while such briefings may help journalists liven up their reports, Mounier doubted such openness would improve the chances for an American pope.

"I feel as a consensus here that a U.S. candidate, whoever he might be, has very few chances once in the Sistine" Chapel, he said. "It seems to be just a matter of general feeling against the Uncle Sam. Nothing more than that."
